Terms of Service

These Terms of Service ("Terms") apply to your use of tempac.net and to every quote, order and purchase from TemPac, LLC ("TemPac," "we," "us"). By using the site or placing an order, you agree to these Terms on behalf of yourself and the business you represent.

1. Who these Terms are for
TemPac sells to businesses, mainly meat processors and other food producers. Our products and services are not intended for personal, family or household use. If a quote, invoice, order acknowledgment or signed agreement with TemPac has different terms, that document controls for that order.
2. Using the website
You may use tempac.net to learn about our products, request quotes, samples, reorders and support, and send us artwork. You agree not to:
- upload files that contain malware or that you do not have the right to share;
- send false information or submit forms on someone else's behalf without permission;
- try to break, overload or get around the site's security, including our spam protection;
- scrape or copy the site for a competing business.
We may block access or remove submissions that break these rules.
3. Site content and downloads
The site's text, photos, video, logos and design belong to TemPac or our licensors. The TemPac and Economarker names and logos are our trademarks. You may download and use our artwork guidelines, dieline templates, color charts and product datasheets to plan and prepare orders with TemPac. Do not republish them or use them for work with another supplier.
Product names such as Yamato, Mettler-Toledo, NiceLabel and EnLabel belong to their owners. Mentioning them does not mean those companies endorse TemPac.
4. Information on the site
We work to keep specifications, minimums, lead times and photos accurate, but they are general information and can change. Your quote and proof set the specifications for your order. Links to other websites are for convenience; we are not responsible for their content.
5. Quotes and orders
A quote is our offer for the items, quantities and specifications it lists, for the period it states. An order is accepted when we confirm it in writing or begin work on it. Forms on the site are requests, not orders; nothing is binding until we confirm it. We may decline any order.
Some labels and inserts are produced for us by trusted production partners. TemPac remains responsible to you for every order.
6. Proofs and approval
We send a proof for every new or changed custom item. Production starts only after you approve the proof in writing.
- Check every proof carefully: spelling, weights, ingredients, allergens, nutrition facts, barcodes, inspection legends, dates, colors and dimensions.
- Once you approve a proof, you are responsible for any error in it, including errors in artwork or text you supplied.
- Changes after approval may add charges and delay delivery.
7. Minimums and lead times
Minimum order quantities depend on the product and printing method and are listed on our product pages and your quote. Production begins after we receive your proof approval and any required payment. Any production or delivery time we give you is an estimate, not a guaranteed ship or delivery date.
8. Color and appearance
Colors on screens and home printers do not match printed results. Digital and flexo printing reproduce color differently, and color can vary slightly between runs, materials and finishes. We match approved Pantone colors as closely as the process allows. Minor variation is not a defect.
9. Prices, plates and taxes
Prices are in U.S. dollars and are set by your quote or invoice. Plate, setup and freight charges are shown on your quote or invoice. You are responsible for applicable sales and use taxes unless you give us a valid exemption certificate.
10. Payment terms
Unless your quote or invoice states otherwise:

Payment terms for all other purchases are stated on your quote or invoice.
11. Overruns and underruns
Printing is not exact. We may ship up to 10% more or less than the quantity ordered. You will be billed for the quantity actually shipped.
12. Shipping and delivery
We ship within the United States, including Alaska. We do not ship outside the U.S. Delivery dates are estimates, and we are not responsible for carrier delays. Inspect every shipment when it arrives, note any visible damage on the delivery receipt, and tell us right away so we can file a carrier claim.
13. Returns and defects
- Custom printed items (labels, inserts and anything made to your specifications) cannot be returned unless they have a printing defect. Report defects within 30 days of delivery, with photos and sample labels if we ask. We will reprint the defective quantity or credit your account, at our choice.
- Unopened stock items may be returned within 30 days of delivery with our prior approval. A restocking fee of up to 10% may apply.
- Scale systems and equipment are covered by the warranty terms in Section 16.
A defect means the item does not match the approved proof or is unusable for its intended application. Errors that appear on an approved proof are not defects.
14. Obsolete labels and artwork
Custom labels not ordered for 2 years or more are considered obsolete. We may then discard the related artwork, plates and setup files. Reordering an obsolete label may require new artwork setup, a new proof and new plate charges.
15. Your artwork and label content
You keep ownership of the artwork, logos and content you send us. You give TemPac and our production partners permission to use them only to quote, proof, produce, store and reorder your items.
You confirm that you have the right to use everything you send us, and that printing it will not infringe anyone's trademark, copyright or other rights. You will defend and reimburse TemPac for claims that arise from your artwork or content.
You are responsible for what your labels say. That includes product names, weights, ingredients, allergen statements, nutrition facts, safe-handling statements, inspection legends, country of origin, barcodes and dates, and their compliance with USDA FSIS, FDA, state and other rules that apply to your products. We may point out issues we notice, but TemPac does not review labels for regulatory compliance and does not give regulatory advice.
Where we describe materials as suitable for food contact, we rely on the material maker's statements. You are responsible for confirming that a label, adhesive or insert suits your product, packaging, storage temperature and process before full production. We are glad to send samples for testing.
16. Scale systems, equipment and software
Equipment. Scales, printers and related hardware (including Yamato and Mettler-Toledo equipment and the label printers we supply) are covered by their manufacturers' warranties. We pass those warranties through to you and help you use them. Apart from that, TemPac does not add its own warranty on equipment unless your quote says so.
Software. Labeling software such as NiceLabel, EnLabel and LabelDirect is licensed by its publisher. Your use is governed by the publisher's license terms, which you agree to follow.
Installation. Phone and remote setup support is included. On-site installation and training are billed separately at the rate on your quote. ScaleManager installation requires a working Wi-Fi network at your site and a remote-access session (we use AnyDesk) that you approve. You control when that access is allowed.
Support. Phone and remote support is currently provided at no charge during our business hours. We may change support terms or introduce paid support plans in the future. Support does not cover damage from misuse, unauthorized repairs, power problems, or use of supplies not suited to the equipment.
17. Warranty
We warrant that custom printed items will match the approved proof within normal printing tolerances and will be free of printing defects when delivered. Your remedy is reprint or credit under Section 13.
EXCEPT AS STATED IN THESE TERMS, TEMPAC'S PRODUCTS, SERVICES AND WEBSITE ARE PROVIDED "AS IS." TO THE EXTENT THE LAW ALLOWS, WE DISCLAIM ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
18. Limitation of liability
TO THE EXTENT THE LAW ALLOWS, TEMPAC IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST PRODUCT, DOWNTIME, PRODUCT RECALLS, OR REGULATORY FINES OR PENALTIES. TEMPAC'S TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE ORDER OR PRODUCT THAT GAVE RISE TO THE CLAIM.
19. Events beyond our control
We are not responsible for delays or failures caused by events beyond our reasonable control, such as material shortages, supplier or carrier delays, severe weather, utility failures, labor disputes or government action.
20. Governing law and disputes
These Terms are governed by Ohio law. Any lawsuit about these Terms or an order will be brought in the state or federal courts serving Stark County, Ohio, and both parties consent to those courts. Before filing a claim, each side agrees to try in good faith to resolve the issue by contacting the other.
21. Changes and general terms
We may update these Terms. The version posted on the site when you place an order applies to that order. If any part of these Terms is unenforceable, the rest still applies. Our failure to enforce a term is not a waiver.
